Terms of Service

1. Acceptance

By using SoloNOC ("Service"), operated by Heron Networks LLC ("Company", "we", "us"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

SoloNOC is a network monitoring platform for IT teams and managed service providers. The Service includes a web application, iOS app, Android app, and monitoring agent software that you deploy on your own infrastructure.

3. Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.

You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you believe your account has been compromised.

4. Acceptable Use

You agree not to:

• Use the Service to monitor networks you do not own or have explicit permission to monitor
• Attempt to gain unauthorized access to any system through the Service
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer or attempt to extract the source code of the Service
• Use the Service for any illegal purpose

5. Payment and Billing

Paid plans are billed monthly or annually in advance. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.

If payment fails, we will attempt to notify you. Continued non-payment may result in service suspension. The Free plan is available indefinitely subject to feature limits.

6. Cancellation

You may cancel your subscription at any time from the billing page in the app — no phone call and no email required. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until the period ends. You may also cancel by emailing [email protected], or by deleting your account from Settings, which cancels the subscription immediately. We do not provide prorated refunds for partial periods.

7. Availability and Service Level

We aim to provide high availability but do not guarantee uninterrupted service. The Service is provided "as is" without warranty of any kind. We are not liable for any loss of data or monitoring coverage resulting from outages.

8. Intellectual Property

The Service, including its software, design, and documentation, is owned by Heron Networks LLC. You retain ownership of the network data you monitor through the Service. You grant us a limited license to store and process that data solely for the purpose of providing the Service to you.

9. Limitation of Liability

To the maximum extent permitted by law, Heron Networks LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business continuity, arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time by cancelling your subscription and deleting your account from Settings. Upon termination, your right to use the Service ends immediately.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.
